The humble Peticion {o}f Luke Marriott
To the right honorable the Lords Justices & Counsell
<Most humbly shewing:> That your petitioner being Lieutenant of a Company of souldiers, which <X> were lycensed to goe for Spaine. Did vpon hearing of the present rebellion in this Kingdome, chang his former intencion: and addressed himself and the souldiers vnder his command to the service of his maiest{y} & of the good Subiects of this Realme
But soe it is that oneApsley one of those souldiers, haveing been a man of a most lewd and dangerous life, contynued soe his wickednes that your petitioner gave him some little reproof for the same for which cawse the said Apsley vowed to take some deepe revenge, and to do your petitioner some mischeif: which he most wickedly did, by taxing him to be a traytor: wherevpon your petitioner was committed and direccon given that he & his accuser should be examined. But as yet your petitioner is not examined at all nor his accuser (as he is informed) Yet your petitioner, being a poore Innocent gent is kept in prison and restrained to from serving his maiesty against the rebells as he willingly would doe And the said Aspsley, (as your petitioner is informed hath since had such liberty that he hath comitted a most notorious fellony though he was commanded to prison vntill he were examined and the busines tryed
Your petitioner humbly prayeth that he and the said Apsley may be both examined: & that he your petitioner may be produced to admitte{d} to produce witnesses against the said Apsley: And if it appeare that your petitioner be guilty of treason or any offence worthy of death or imprisonment He desireth the greatest punishment the law can inflict vpon him, Otherwise humbly praieth to be inlarged, and suffered to adventure and giue his Liffe and service for his maiesty & his true Subjects
And as duty byndeth, he will ever pray for your good honors

<Y:> The L. Chiefe Justice of his Maiesties Court of Common Pleas, is required to examine as well the Petitioner, as the said Apsley who accuseth him, and the Examinations so taken to returne vnto us.
