Thexamynation of Morough Magill Patrick o Donell of lutterellstowne yeoman taken before vs Daniell Huchinson and Jo: Bisse Esquires Two of the Jus s tisses Justisses of the peace for the province of leinster the 27o no: 1652
the sayd examinant beeinge duly sworne & xamyned sayth that hee knew Dulin Burne of Ballynekhelley in the County of wickloe, who was kild, beetwxt the first of november 1651 & the last of december next then followinge neer the house of Tho Birne of balynekheyell afforesaid by Phelem mc Terlough Birne now in prisson in the 4 Courts & with him was a litle youth a nepheyw of his viz Laurence Birne, his Cause of knowledge is that hee (this examinant) was present in the said house of Tho Birne when & some words of difference lendinge to a quarell did did pass beetwixt the sayd Dulin Birne & the sayd Phelim, & the Company (that were in the said house, viz a brother of him that was killd & 3 or 4 more whose names this examinant now doth not Remember) did disarme the sayd Phelim of a peice that hee had, and disarmd the sayd Dulin of his sword & skeane, & this examinant sayth that hee knows not which of them went first out of the house & sayth that some of them that were ther were drunk, but whether the man that was killd or hee that killd him were drunk or not (or eyther of them) hee can not tell, hee further sayth that the said Dulin (after hee was without the house) Came back & askt for his sword, & the sword beeinge hiden or deliuered to another, hee tooke out a stick that was

The barr of the doore, and hee this examinant sayth that hee did not see the stroke that the sayd Phelem Gaue to the said Dulin, but hee heard severall that were without the house sayinge that hee killd him with a smale skean Caled a medock, & this examinant heard the said felem Confess that hee kild him, & this examinant sawe the wownd in in the one of his brests (but which breast hee knows not) & sayth that the said Dulin spake (not that hee heard of) after the sayd wound was Giuen him, & further hee sayth that as hee thinks the wound was in or vnder the left breast & that it was not aboue an Inch brode but hee thinks it was too his hart in depth, & further sayth not
