The Examinacion of Luke Toole of Castlekevin in the County of wickloe Esquire taken the xth day of September 1652 before vs Sir Gerrard Lowther knight Sir Edward Bolton knight & Tho: Dongan Esquire Commissioners for Aministracion of Justcice Oyer & terminer & Gaole delivery & william Basill Esquire Attorney Generall for the Comonwealth and one of the Justices of peace for the province of Leinster as followeth
Whoe beinge questioned & Examined concerninge the hangeing & putting to death of one Ann Birne saith that the said Ann Birne was taken at as a Spye at Glancree <A> in the County of wickloe by some of the soldiers vnder the Comand of Bryan mc Phelim Birne and saith that the said Ann was afterwards hanged by the saide Soldiers at Glancree aforesaid in the saide County by Donogh Doyle of Glanmalur ry in the saide County And that this Examinant Confesseth that the saide Ann Birne was brought before him twoe or three tymes and that she was accompted a Spye and to have given intelligence to the English parties and further saith that the said Ann was carryed back againe from this Examinant but denyeth that he this Examinant did ever give any order or directions for the execution or hangeinge of the said Ann Birne and saith that if he could have taken the before named Donogh Doyle he this Examinant would have hanged the said Donogh for hangeinge of the said Ann Birne. And further sayth not.
