The Examinacion of Nicholes Kent of Dainstowne taken the xth day of February 1652 before vs whoe haue herevnto signed he being Duely sworne sayth
<A> That he hath knowne John Elliott this two or three years past and sayth that in the summer was twelve moneth he this deponent accidentaly did meet vpon this deponents owne land between Dainstowne & SlanderCusack with A brother of the said <Cusack> and one Barthollmew Plunkett Thomas Duff and One Bedlow all one foote who were goeing together in the way to Slanduffe and this deponent then walked along with them towards Slanduff and soe walking the sayd John Elliott ouertooke them in the way being one horseback and ryding close vpon them they stood vp all close together and gaue him the way some of them (and perticulerly this deponent) ciuelly saluting of the said Elliott and iust as he came euen by them he shott of his Pistoll amongst them or his pistoll went off where and therewith soe wounded the said Cusack that he ffell imediately downe amongst them and the said Elliott still Ridd a little distance beyond them and then turned about and looked vpon them askeing them or some of them if the shott had hitt any of them but this deponent and the rest being all amazed at the fall of the man gaue him the said E l liott noe answere as this deponent Remembers nor did the sayd Elliott stay any tyme for an answere but Galloped away presently, and as soone as the said Elliott was gonn this deponent and the rest did search where the wound was and f opening his clothes found it to be in his side aboue his wast

And vpon then this this deponent parted from them and <C> went to his owne howse leaueing the rest of the Company with him said Cusack who carryed him to Thomas Duffes house that was one of the Company where he lay languishing a d day or two as he this deponent remembers and then dyed of the sayd wound, and this deponent further sayth that he was at the buriall of the saidCusack about 3 days after he was soe shott by the said Elliott. And this deponent further sayth that he hath heard by some of the Towne of Skrine that they sayd Elliott did about a quarter of a yeare before Kill an another man that was a country man and noe souldier And further sayth not.
