The examinacion of James Dalton of Mooretowne in the County of Kildare gent aged thirty five yeares or thereabouts taken the xijth day of August 1653 taken before Colonel Thomas Herbert and R Doyly Esquire two of the Comittee appoynted by the High Court of Justice sitting at Dublin for taking examinacions of Massacres and murders &c
Whoe being duly sworn and examined deposeth and sayth That Andrewe Buy Tuite of Killane in the County of Westmeath Esquire met with this examinant vpon the land of at Molluimyeghan in the sayd County and taken him the night before Edmund Dalton was executed by the <A> Rebells, and told this examinant that the sayd Edmund was taken prisoner by the Oliver Magawly whoe intended to where he conceived would put him to death and as was generally reported in the Country And wished the examinant to make haste vnto the father of the sayd Edmund and lett him knowe so much And willed this examinant to desire his sayd ffather to make speed and rayse men to see{k} out the sayd Edmund and reskue him out of the hands o{f} the sayd Magawly wherevp which the examinant accordingly performed; and the next morning Mr Richard Dalton father of the sayd Edmund gott divers of his friends and followers and made gr{eat} haste to seek out his sayd sonn And went himself w{ith some?} of his friends one way And this examinant with others o{f} them an other way to fynd out the sayd Edmund with inte { n } { } they could to rescue him from the sayd Magawly { } as this examinant with his company went on his way tow{ards} the howse of James Magawly brother vnto the sayd Oliv{er} <B> where he thought to have found the sayd Edmund Dalton, { } by the way before he came to the sayd James his howse h{e} mett with the him and his Mother and the sayd James as{ked} this examinant wither whither he was going in such haste w{ho} and answered that he was goinge to seeke for the sayd

sayd Edmund Dalton whom he heard was taken prisoner by his brother Oliver Magawly and to indevor to save his Lyfe if he could to which the sayd James replyed <C> that it was is noe great matter what becomes of him And Ann fitz Gerrald Mother of the sayd Oliver and James sayd vnto this examinant that shee hoped they did not nurse him so Longe, And then the examinant and his company went presently to the howse of the sayd James Magawly and his Mother and searched the same but could not fynde the sayd Edmund and soe departing thence went about halfe a Myle distant from the sayd howse where they found a grave newly made and digged vp the same and found the sayd Edmunds dead corps burried there which they tooke vp and brought the same with them to his sayd fa thers howse back the same way [ ] and as they passed by the sayd James M agawlies howse with the sayd Corps to his sayd ffathers howse and afterwards buried him in the Church of Ballymoran in the sayd Countie it being his fathers buriall place And this examinant further sayth not
