<X> <13> Nicholas Elliott aged 35 yeares or thereabouts being sworne & examined saith, that about May was & twelue month, he was taken prisoner by Captain <C> dauid Roch Lieut: dauid Roche & Ensigne James Barry & seuen of their company & t h & kept him prisoner till the next night of which time afterwards they tooke Mr Thomas Madox & carryed them with Isaac Ellis another prisoner towards a certaine Hill westward from Muckroome, & at the foote of which hill they let them rest a while & smoake tobacco, & the said Captain his Lieutenant & ensigne drew a side to consult; & then came to the deponent & the other prisoners & drew two of their Company at then the Captain ordered the Ensigne & those two of their souldiers to take a long with them Mr Maddox, and Isaac Ellis, & march to a certaine Cabbine, distant from the party which they did; & not long after this deponent

heard a shott, & did imagine they had kild either Mr Madox or Ellis; & When they returned came again to the party, & the said Isaac Ellis declared to the deponent that they had murthered Mr Madox. that they first stab’d him, & then shott him, & after cutt his throat & further saith & that they had done the like to the him & this deponent if they had not compounded for their Ransom & alsoe to this dep & further saith not.
