The said Richard Phepps (in addition to his former examinacion, before set downe) further deposeth That hee this deponent was present in the late high Court of Justice at Corke before Justice Donnellan, the Lord of Broghill & other Commissioners vizt in or about the moneth of december now last past in the yere 1652: When & where one John Nagle whoe was an officer or Comander vnder Mr Henry Beecher of Iniskerkin did (viva voce) depose and vpon oath before the said Commissioners declare, That Mr david <Deposed as before> Nagle his father haveing lost & been deprived of same Cattell in the begining of the warrs, hee the said John <E> Nagle went into Roches Countrie to seeke for them, but that he could fynd none: And that in his retourne home to his fathers howse westward; he was taken prisoner by McCartie Reogh & his partie of souldiers (he the said McCarty Reogh then rideing in the vann), & being cheef Comander of them, And that then & there he the said John Nagle was putt to his choise (but whether by the said McCartie Reogh himself or which of his partie this deponent remembreth not) Whether he would take vpp armes & serve the said McCarty Reoghe & Act with his forcs, and on their partie, or be hanged, (as other Englishmen were) to the best of this deponents now remembrance, but that the said John Nagle (to save his Liffe, did (vnwillingly) agree to serve amongst them for some tyme: And that in the tyme of

of such his staying with them hee sawe three or <f> fowre Englishmen hanged by the said McCarty Reoghs forcs in the presence of him the said McCarty Reoghe in or near the parrish of Kinneath in the Barony of Carbery: Hee then further deposeing and saying that he could well remember the same the better, or by a good token: for that one of them that was soe hanged was a young English man in a redd Cassock whom they sayd was a spie, & whom they hanged so lowe that his tooes touched the ground. And that then his executioners fynding some Biskttt & cheese in his pockett, tooke peecs thereof, & crammed them in his mowth when he was dead calling him English Churle, & asking him if then he would eat any bisket & cheese or to that effect to the best of this deponents remembrance: And further saith that he this deponent very well knew him the said John Nagle, & still thought him to be an honest man And also very well knew him to be an honest & stout souldier on the English partie both before and after the time that hee escaped & gott away from the Rebells: And beleeves whereof verely that he deposed nothing but what was true: And the Deponent too well knoweth that the said John Nagle is since drowned.
