The Examinacion of Phellymy Smyth taken before vs the ffirst day of May June 1653
Phelemy Smithe of Balleculter in the Barony of Lecale County of Down, sworne and examined before vs sayth tha{t} Redmond ffitzymons one of his neighbors being then aged 6{ } <A> yeares of theraboutes went into Kinallerty for the preservacion of his liffe seeing his neighbors a killing by the Scotts sould{iers} & acting nothing against them and when some rule and settlement Came amongst them, the said Redmond ffitzymones sent a woman to this deponent into Strangford where he was then souldier of the Company of Captain Valentin Payne, Signifying that he the said Redmond durst not Come home saffe with his Liffe without a protection or a passe from the Lo: viscount Clanneboyes, whervppon this deponent tould his said Captain of the said womans message vnto him, who soone after went into Killeagh and gott a protection relating vnto the said Lo: of Clanneboyes of the said Redmonds honesty & Conversacon & acting noting preiudiciall to then gouernment, which protection <B> was deliuered vnto this deponent who sent it vnto the said Redmond ffitzymones by his owne wiffe Ewny Smyth and when he Came into the Barony of Lecale this deponent went to meet him fearing that any should doe him hurt or pilledge him; And soe meeting him & going towards the garisson of Strangford aforesaid they were mett with by one Thomas Dixon now prisoners & Jordy worke the <same Dixon> the said Dixon now prissoner before the high Courte of Justice for another murther, this deponent knowing his wickednesse before that tyme & to prevent his furie went before and tould the said Thomas Dixon that the said Redmond ffitzymons had my Lo: of Clanneboyes protection

which protection, the said Redmond shewed the protection vnto the said Dixon nott withestandinge which the said Thomas Dixon drew his sword and murdered the poore ould man Cutting him in peeces & tooke away his mony & lefft <C> him there at Mullaghbane neere Ballenary where he is lying buryed in the same place, & except that this deponent had a horse to Cary him away he had been soe serued as hee beeleeveth And this deponent by vertue of his oath sayth that he did heare from Credible persons that the said Dixon was one man who Murdered Cormucke ma Guine with his owne hands at Ard glasse
The said examinant Phelemy Smith further sayth that the said Thomas Dixon & Jordy worke did kill another man that night being in the euening late) the month of May 1642 named One o Sterky a poore ffisher who had this deponents Lieutenants letter namely Leutenant Abraham to come to him to be his ffisher, And this deponent further sayeth that he prayed the said Thomas Dixon to Cary the said Redmond ffitymons and One o Sterky prissoners with him vntill his Captain or Lieutenant had come in place yett he most Cruelly did not but murdered both. his Cause of knowledge is appereth And further sayeth not for that hee this Examinant was present when the sayd Dixon kild the said Redmond ffitzmons & that the said Dixon & Jordy work kill the for named o sterkie. And further sayth not the cause of his beeleife thereof is for that this this deponent when he fleed from them at the killing of ffitzymons, hee then sawe the said sterky in theire hands who the next morning was found dead in the same place whene fitzymon was kild
