The Examination of Oliver Symms taken the xxixth day of Aprill 1642 Before mee Chancelour of his Maiesties Court of Exchequer By direction of the right honnorable the Lordes Justices & Councell.
Who beeing sworne & Examined, saith, that on Tuesdaie last hee this Examinant & others comeing vnto this Cyttie with wooll of the Earle of Castlehavens, they were sett vpon a litle on this side of Rathcoole by about a hundred of the Rebells the cheife of them beeing sonnes to Scurlock of Racredan, which said Rebells killed ffoure persons of those who came along with this Examinant vizt an Englishman his wife & child & an Irishman two men , a woman & a childe, who likewise wounded him this Examinant & two others of his companie & carried awaie with them three waines & a Cart loaden with the wooll aforemencioned which waine & Cart they caused him this Examinant to driue vnto Kildrought & from thence a Mile further towards Sir John Dungans house But there haueing beene some of Sir John Dungans servants att Kildrought att the tyme when this Examinant & the said carriage was there who heareing that the said persons & carriage belonged vnto the Earle of Castlehauen went and acquainted theire said Master therewith, as this Examinant afterwards vnderstood who presentlie ridd forth with three or

ffoure in his Companie & meeteing with the saide Rebells hee tooke from them the said carriage and prisoners And told the said Rebells that hee would keepe both the Goodes & persons soe belonging vnto the Earle of Castlehauen for his Lordshipps vse But beeing demanded whether anie of the said Rebells were killed or wounded by the said Sir John or any of his companie saith that the saide Sir John spake sharpe languadge vnto them with his pistoll cockt & that one of his the saide Sir Johns sonnes strake two or three of the said Rebells with a halfe pike And soe the said Rebells parted and left the carriage & prisoners to goe vnto Sir Johns house. And this Examinant beleiues that if the said Sir John had not come the said Rebells would haue hanged & killed him this Examinant, & the others rest with him
