The Examinacion of John Magher of Burgh in the Kings County yeoman aged 20ty years or therabouts taken befor vs the 25th of October 1652
The said examinant saith that hath been a soldier vnder the Comaund of Capt ai n Leiftenant John Butler fittz Peirce, & that Thomas Grace was his <A> Ensigne who was lately executed in kilkeny: & continued vnder that comand [ ] twelmoneths if not more; he further saith that ther was an Englishman whose name he knoweth not that was taken out of Brittas, & from thence carried towards a place called Ballicanmore in the County of Kilkeny & ther murthered murthered, but by whom he knoweth <B> not, and ther the abouenamed Thomas Grace, he with Edmond Rosanan, Henry Archer William Hanrighan, William ffogertie & James o Mara were present att the tyme of the murther & that William ffogertie belonged to that Company but whither he was present at that tyme or not, he doth not know Being further examined of his cause of knowledge he saith that coming from Monely & going to Kilb racca n kilbar cca [ ] for a shirt he had left ther, the said Thomas Grace stayd him, & told him that he must stay with him for that he had intelligence from some of the Countrye ther that ther was an Englishman in Brittas that was an Enemy to them, & that he was perswaded by some of Countrey (whose names he knoweth not) to seize vpon him & putt him to death, whervpon he stayd, soe said with the said Grace a pistoll shot [ ] <from Brittas aforesaid> till the the Corporall one William Boylan, John Magher, & James o <C> Maira brought the said Englishman to the place wher the said Grace he this examinant & others stayd; and from thence carried him to Ballicanmore aforesaid wher he the said Englishman was putt to death <& that he this examinant > stayd some distance (about a pistoll shott) from the place of execuion <D> Being a sked what that John o Magher was, & wher he now is, he saith he was a soldier in the same company, & did sometymes execute the place of a Corporall, & is now gone with Collonel Bryan McShan, but company of other soldiers, but whither he be gon beyond the seas he knoweth nott
