the sayd Examinant sayth that in or about february 1650, hee this examinant with 8 or 9 more of Lieutenant Coll Scurlocks troope were sent to to levye Contrybution of the Inhabittants of Chappellizard & other places thererabouts and that this examinant & three more Came (then, vpp towards the fenix, about one a Clock in an after noone) & as this examinant & the other 3 men afforesaid were Retorning from the ffenix, thay sawe some musquetteers Ro who had Rescued a pray of about 15 or 16 Garrans which were taken by the men of the said lieutenant Collonell Scurlocks troope afforesaid & the sayd musquetteers did shoot at this examinant & the Rest of the men, where vpon this examinant & the other 3 Rode towards 3 of the said musquetters, & this examinant followed one of them, by name Owen Helye (as one of them that were taken tould this examinant & the Rest, affterwards, & the said Owen Ran through a ffallow feild, out of a ditch & tooke another

another ditch, & soe faced about & presented his peice, & R[ ] this examinant bad him to take quarter - & hee made noe answer but presented his peice, & as this examinant was passinge bye hee shott at this examinant, & there vpon this examinant Got ouer the dich & pystold the said owen wherevpon hee fell & as this examinant heard, aft hee dyed there & one of Th Grymes, that was in the partie with this examinant, brought away his peice his sword & his hatt
