The Examinacion of ffargus Birne of Mountaine in the Countie of dublin farmer taken the xiiijth daye of September 1652 before vs Sir Gerrard Lowther knight Sir Edward Bolton knight & Thomas Dongan Esquire Comissioners for Administracion of Justice Oyer & Terminer & Gaole delivery &c and William Basil Esquire Attorney Generall for the Comonwealth and one of the Justices of Peace for the Province of Leinster as followeth
Whoe beinge sworne and examined saith that about a yeare since Phelim mc Tirlagh Birne of Killenemanagh in the Com of wicklo was a prisoner in dublin and that after the said Phelim gott his liberty and went into the Contry he the said Phelim tould his brother Bryan mc Tirlagh Birne in the heareinge of this Examinant & divers others that Hugh mc Laughlin was in dublin and gave intelligence to the Governor of dublin of all the Actors in the Murder of Jo: Joyce and of all their doeings and proceedings, and that if they should not be cut of the said Hugh mc Laghlin and his sonns they the said Phelim and his frends should be dayly discovered and be able to doe noe good in the Contry and that he the saide Phelim would be the death of them if he could meet them in those partes And this Examinant further saith that about a yeare since dudley Birne of Behenagh in the County of wickloe this de Examinants Brother in Law was by the saide Phelim mc Tirlagh killed at Boylenekilly in the County of wickloe the cause of his knowledge is for that he this deponent sawe his Corps after he was deade and saith that he had one stabb with a skeane about his heart and saith he was at the buriall of the saide dudley And this Examinant further saith that Maud Birne, Cahill Birne, Thomas mc Moyla Murrogh mc Gilpattrick Mary Birne, and Donogh Birne, affirmed vnto this deponent that Phelim mc Tirlagh murdered the saide Dudley Birne & that they were present when he did the same, He further saith that he this deponent haveinge caused the said Phelim to be apprehended and brought to the Gard at Kilmainehan

on Saterday last he the said Phelim confessed both in the presence of this deponent and severall others that he the said Phelim mc Tirlagh did killed the said dudley with a Skeane and further deposeth not.
