The Examination of { } late of Diserts in the Queens Cou{nty } 55 yeares or thereabouts taken the 4th {of} September 1652.
The said Examinante being duely examined saith that he lived in the begining of the Rebellion Neere Doundalke at Carristikin in the Countie of Arramath and being demaunded when hath he taken vp armes saith that he tooke vp armes by Comaund of Hugh Birne Roger o Moore and Sir Phelym <A> o Neale soone after the breaking out of the rebellion and his first comaund was a Capt: of foote and his Comission was giuen him by Hugh Birne and Roger o Moore and being demaunded whether he can produce the said Comission he saith the same with rest of his papers is was lost and further saith that the first seruice he went vpon as and being demaunded who gaue power and authoritie to the said Hugh Birne and Roger o Moore to giue Comissions the Examinate answereth, that he knoweth not, and being demaunded what which was his first {seruice} he saith in the defeate of Lt Collonel Roopers partie some three Myles from Droheda, and being further saith that he had sometimes an occasion to ride thorough {the Queens} Kings Countie to Kilkenny but made noe abo{ad th}ere but his aboad was neere at New Castle with his { } neere Terrells passe being further demaunded whether {he} knew one <B> James Dowdall, he answeres J he knew James Dowdall of Eathenderrie in the Queens Countie seruant to Sir William Cowley, and further saith that he heard tha{ } an Englishman in Mr Husons towne in the Q{ueens Countie} was murthered by Paule mc Killofoile this { } souldiers and being further demaunded whether he { } that Paule the murtherer to Justice he saith { } said Paule upon the hearing thereof fledd as { } saith that he came thorough Iregan to M{ } by order {from} the Councell garrisoned { }

battle of Rosse then he left the said Monerath [ ] neere Ballyfinn and being further saith that he knewe not William Broake neither does he knowe that he was murthered at Ballyfinn nor by what person the said Broake was murthered being asked what outrages the Examinante and his partie <C> comitted vpon the English saith that he tooke that he comitted none but [ ] none but by takeing of Cattle from the garrisons as Marriburrow. Ballyknocan and Cullenagh, Disert Stradballie and all others wherein English were which were garrissoned, being further demaunded. whether the Examinate together with his brother Roger Moore sent to the seuerall sects that were banished from Leix by the Commissioners of State for the said sects (to enioy their former lands) he answeres that the Examinante neuer sent for them, but that his said brother Roger Moore sent for them to serue as souldiers, and further saith that he knew Lt Walker and an other Lt and further saith that he heard that the said Lt Walker and the other Lt were murthered betwixt the Shan and Marriburrow but by whom he knowes not, and being demaunded what goods the said Lt Wolker & the rest rest had he saith some horses and Cows, and the Examinante saith that he hath a grey nagg that was reported to be the said Lt Walkers which the Examinate bought of a souldier of Collonel fitz Patrickes partie called John Dowly now liuing at Ballyaskill and since vnder his owne comaunde, being further asked whether the Earle of Castlehauen spoke to this Examinate to finde out those that murthered the said Lt Walker and the rest, he answeres he did and would not [ ] , but saith that the Earle of Ormond neuer speake to him nor writt to him to finde out the said murtherers. [ ] & that vpon the desire of Castlehauin, he made inquirie after the said murtherers. but he could not finde them out, being further Examined whether he had a bey horse that was the said Lt Walkers charging horse he saith that the same was sent to him as being taken from the garrisson of Cortneck{ } but neuer sawe the same and further saith not.
