Whoe beinge Duely sworne, and exa{myned sayeth} That aboute elleven yeares sithence This {examinant} was att the Dwellinge howse of one Toby Emotts of Walterstowne in the County of K{ildare} <A> And that about three weekes before Christmas in the first yeare of the Reb{ellion} there Came vnto the said Tobye Emotte his howse one Edward ffitzgarrard of Ballybarney in the County of Kildare together with about sixe ffootemen in his Company, and Required that the Doore should be opened, And this examinant sayth that the said ffitzgarrard threatened that yf he should not be admitted in, he would breake open the Doore, wherevpon this examinant did speake vnto the said Edward ffitzgarrard and tould him that yf in case he would not doe anie hurte to those that were in the howse, he should be admitted in, And that that therevpon the <B> sayd Edward ffitzgarrard did promise this examinant together with sewerall others that then were with this examinant in the howse That he would shed noe Bloud of any person within the said howse, nor suffer a haire of any Persons head within the said howse to perishe, And vpon the said Edward ffitzgarrard his engadgement he was admitted into the sayd Toby Emott h{is howse} And that then the said Edward ffitzgarrard {did?} imediatly seize vppon the said Toby Emotte {and}

Samuell Emott his sonne, and Carryed them away prisoners, And that this examinant then Continued in the sayd Toby Emotts howse, And that about the first day of January then followinge she heard that the said Tobye Emotts was Kylled, by some persons, which are sithence dead and hanged, And farther sayth That the said Edward ffitzgarrard which is nowe in prison in the Custody of Marshall Peake, is the very same Edward ffitzgarrard that Came vnto the Doore of the dwellinge howse of the said Toby Emott, and entred the sayd howse vppon his pretended engadgement and which tooke the said Toby Emott and Samuell Emott his Sonne prisoners and Carried tooke them away as afforesaid with him The sayd Tobye Emott beinge murdered about three weekes after he was soe taken away And that this examinant sayth there is nowe onely one William Dauis of Raue bride in the County of Kyldare Liueinge of those sixe men <D> which came to the doore, and entred the said howse, And that the sayd William Dauis was in the sayd Edward ffitzgarrard his company in the said howse when the sayd Toby and Samuell were taken prisoners, And farther sayth not

Memorandum That the said 18th day of January 1652 the said Sarah Emott Came {personally} before vs and entred into Recogniza{nces} and acknowledged herselfe to be end{ebted} vnto the Keepers of the Libertye of {the Comon}wealth of England in the Summe {of} one hundred pounds to prosecu{te the} sayd Edward ffitzgerrald for th{e crime?} afforesayd, att the next Sessiones behoul{ } for the County of Killdare att t{he} Courte ffor Administracion of J{ustice} &c
