The Examinacion of Owen Kennedy of Irishtowne in the County of Kildare yeoman aged thirty six yeares or thereabouts taken before Colonell William Edwards Esquire and Tho: Richardson Esquire members of the high Court of Justice sitting at Dublin by Order of the same Court the seacond day of december 1653.
The said Examinant being duely sworne and examined sayth that hee was living in the Calloe in the County of longford when Hugh mc Bryan fferrall was killed, and within two <A> miles of the place where hee was killed, about three or foure yeares since (to his best remembrance) And further sayth that (by the Common report of the Countrey) it was Captaine Cruise and one of his brothers that killed the said Hugh mcBryan, And as hee heard it was as followeth (vizt) that the said Captaine Cruise seeing the said Hugh mc Bryan (after they had bin at Masse together) said to his brother there is one that owes you twelue pence of your meanes, take his cloake till hee pay you, whereunto the said Hugh mcBryan made answer saying there is my house neere, and my Cattle, where you may take my powne, but you shall not haue my Cloake, whereunto the said Captaine Cruise Replied you Roague you shall parte with your Cloake now, And that the said Hugh mcBryan fferrall seeking to defend himselfe and his Cloake was killed by the said Captaine Cruise and his brother, (who was then one of his Soldiers) but which of [ th ] his brothers

the Examinant doth not well remember but sayth that (to the best of his memory) hee was called Richard Cruise, And the Examinant further sayth that by like common report of the Countrey the said Captaine Cruise was comitted prisoner and kept afterwards as a prisoner in the said ffort of Ballileag (for some tyme) for comitting the said murther, and was lett out vppon his faithfull promise to returne into the said ffort againe within some short tyme after, but having gotten his libertye hee did not returne to the said ffort any more, as was also generally reported, and the Examinant beleiveth to be true And further sayth not
