The Examination of Stephen Baetman taken before vs this 30th of Nouember 1652
The said Stephen Baetman being sworen upon the holy Evangelist sayth that in the nine dayes Sessation in S[ ] September 1642 he with others in his company went nere vnto Mountaine Castle beinge there vnto invited there cam Captain Edmond ffennell with a party of Horse and fell vpon vs with force of Armes (we no wayes resisting him or his party by reson of the Sessation) and killed <A> Ensigne Coole then Ensigne to Captain Hugh Croker, Thomas Clements Miller and on Burne a Butcher the rest of our party being taken prisonors; the said Captain ffennell asked of on that was by whether any of Capoquin blades was escaped whoe replied that there was but one where vpon Captain ffennell forced vs to goe into the gre{ene} at Mountaine Castell nere Capoquin and asked whether any had given quarter or not, then answare was made him by Liutenant John Legg then Liutenant to Captain ffennell and others of of that party that they had given quarter to those prisonors they had, the said Captain ffennell replying againe that there was none of them had power to give quarters, and that none had quarter but Barry Croker, whome he gave quarter vnto, where vpon he the said Captain ffennell caused Richard o Rely and another to be taken out from amongst the rest of the prisonors and drawne vp by a rope to the limbe of a Tree and hanged, Captain ffennell not leveing the place vntill he saw them both dead, and then Martched the rest of vs to Dungarvan and from thence to Carigneshure and from thence to Clonmell where we remained in prison six or seven weekes
