<5> John Salisbury of kilworth in the County of Corke Tyler Mason beinge duely sworne and examined deposeth and sayth that he liueinge att kilworth <ff> was forced to li u e in goe in to Cloghleigh for the safegard of his life, after which Sir Arthur Hyde knight lefte the Castle by night after which Richard Condon of Ballymapatricke Came and demaunded possest himself of the sayde Castle of Cloghleigh left in the Chardg of one John Haryson; whoe deliuered itt vnto him, a most of the English beinge sent into Castl lyons with the heire of the Castle (Mr ffrancis ffleetwood not beinge aboue ten yeares of age) the exam deponent stayinge there in regard beinge a Mason was kept prysoner by them because he might be serviceable vnto them, and after some smale tyme was released to stay with them his the said deponents wife beinge of the family of the Condons & that not longe after he did see one Charles fflyn brought from Coole, att which tyme Mr Richard <G> Condon of Ballymapatricke aforesaide Came of the Castle into the Barbaken doore and there he did see the said fflyn and sayde vnto him oh Tirragh yow haue forsaken your religion & your Country yow shalbe a Martyr, and then immediately the said fflyn was Conveyed to the gallows a tree within shott of the Castle and there hanged, beinge presente a greate multitude whose names he Certayntly knoweth not, and that the rope broke and then they <h> kna one david Condon now of Cloghleigh strucke him vpon the head whereby he fell of from the Roche to the watersyde, and afterwards he was buryed, And beinge further examined he deposeth & sayth that one Moses a sawyer Comeinge to Cloghleigh for releife beinge an English man, Richard Condon of Ballydergan beinge in Company with one this deponent and one Edward Head now very sicke and liueinge in kilworth) sayde vnto them sett yow still he haueing a rope in his hand went out and putt it out aboute the sayde Moses his necke and ledd him into the Orchard and there his man threw the rope over a bow of the Ash and drew him vpp and the sayde

<k> Condon tooke hold on the sayde Moses and lifted him from the ground and there he was immediately hanged his Cause of knowledge is for that this deponent beinge in Company with the sayd Condon when he went out with the said man Moses, & this deponent goeinge out to make water did see what he hath deposed of to be true, & then the sayde Condon Came backe againe and sayde Nedd hede I haue hanged vpp the Spyder, And further deposeth that one John Bawne and of the Garyson of Michelstowne was taken prysoner by some of the Guard of Cloghleigh and aboute a weeke after Mr Richard Condon of Ballymapatricke Caused him privately <L> to be Carryed out to the gallowes, and hanged by one dermott รด Lyve, because the sayde Bawne as Richard Condon sayde had shott the his Targe{t} att the tyme when he and his Company went to Slemacluggy And further sayth not:
