This deponent answered that he this Examynant was fearfull & not ffitt to watch, or take Chardg of the said Phips, the said dermod Replied, that he should not be Long Chardged with them him after the said dermod had soe said, he departed, Leauing the said Philps in the Custody of this Examynant & the said Teig ô Murryhee & the said John mc donnogh, whoe stayed parte of that night <C> with them, & afterwards left them, And the next morneinge the said John mc donnogh Came vnto the howse of the said Nicholas and Teige, And tould them that by vertue of a Command from dermod ô Mawhowne, they were to Execute or hang the aforesaid John Phips, Whervppon the said John mc donnogh, & Teige ô Murryhoe Carryed the said John Phips, to KnockaCullane wood, being neare halfe a mile from the Cabbin or place wher he was kept prisoner the night before, And this Examynant went for a shouell and Spade, accordeing to the directions or Command of John mc donnogh wher he Sawe the Sawe John Phips, draweing vpp a Cros the Lymb of atree by the necke, whervnto this example gaue his assistance, & Likwise in the buryall of him & further he Sayth not.

Nicholas O Moyran aged abot 36 yeares duely sworne & Examyned Sayth
<B> That in the Spring tyme as he Remembers in the Second year of the Warrs, dermod o Mawhowny & one John mc donnagh the said dermods Seruant brought John Phips to this Examynant & to one Owen Teige ô Murryhee, to their howse they, both dweling in one howse, & further Sayth that the Said dermod Chardged this Examynant, & the said Teige ô Muryhee to watch with him, & keep him Saffe that night vppon payne of death
