<Captain> George Purdon of of Clonadrummon in the Countie of Limericke sworne & examined deposeth & saith That he this deponent about twoe yeres & a half since comanding a party of horse on the English partie: And being quartered at the Castle of Pallis in the same Countie comanded twoe of his troopers by name John Mc Nemarra (an Irish protestant, one Brian Carr (also a Protestant) to goe to Castletowne in the said County to demand & (if need were) to distreigne for some money assigned him for his men: which said John Mc Nemarra & Brian Carr takeing their horses & rideing about the same were surprized & suddenly taken in the way by a Lieutenant & a partie of the irish of the Regiment <A> of Sir Edmund ffizGerald of Gortnetubbrid in the same County who [ ] gave them quarter for their Lives: yet carried them to the Woodes of Kilmore & there as this deponent was credibly enformed, kept them tenn days prisoner: & then brought them to the Mountaines of Slevelougher to the said Sir Edmund fitz Geralds howse Campe to whom the deponent writt a Letter to have his men either discharged by ransome or exchang vnto which letter the said Sir Edmund retourned Answere in writing vnder his hand that vnles this deponent would send back vnto him one David Dobb whoe (he sayde ran away from him, & was in deed the with him this deponent that then hee would hang his this deponents said twoe men Wherevnto this deponent by writing replied That he would not soe much discorrage any of the Irish partie for comeing to him as to send away that partie & hoped that the said Sir Edmund would be soe careful as not to hang this deponentes men: yet notwithstanding the said Sir Edmund assisted <B> by Maior Gerald oge ffitzgerrald, & Captain Dominick Roch, hanged the said Brian Carr contrary to the Quarter given him: And not Long after the said Dominick Roch suffered the said Mc Nemarra the deponentes other man to come away vpon his paroll to procure one of the Irish partie to be exchanged for him: & accordingly this deponent discharged one of the said Maior ffitzgeralds souldjers fo in exchange for him & there vpon the said Maior ffzgerrald allowed the exchange & [ ] vpon that by writing vnder his hand which this deponent thincks he can prod{uce} gave a discharge to & for the said Mc Nemarra: And afterwardes whenas this deponent taxed Maior fz Gerarld aforeaid (in the presence of Lieutenant ffoulks) how vnlawfully the said Brian Carr was hanged contrary

to quarter he the said Major ffitz Gerald vttered theis wordes & voluntarily swore vpon a booke That he the said Maior did not hang him but that Sir Edmund ffz Gerald did hang him: & that Sir Edmund had hanged the other souldjer (meaneing Mc Nemarra) too if he had not hindrered & prevented him Or wordes to that effect
