The Examinacion of William Stowell of Oxmonton taken before us Sir Richard Bolton knight Lord Chancellor of Ireland & Sir Gerrard Lowther knight Lord Chief Justice of his Maiesties Court of Comon Pleas
<T:> This Examinant saith that yesternight about eleven or twelue of the clocke Lieutenant Henry Smith called him along to Mr Darcy his howse & coming thither this Examinant dem demanded of them in the howse what strangers were there & whether one Birt were there whereto Mr Nicholas Darcy made answere that there was none such there whereupon some other in the howse said doe not dep deny him for he is heere & this Examinant tould Mr Darcy that he this Examinant heard the said Birt speakeing out of a window in an upper roome then Mr Darcy desired this Examinant to come in & drink a cup of beere whereupon this Examinant with the Constable & one or two more came in and Mr <V> Darcy caused the dore presently to be locked upon them & then Mr Darcy desired this Examinant to giue his man the word to fetch a litle Tobacco whereto this Examinant answered that he would take none neither would he giue any man the word thereupon one Birt came downe the staires & asked this Examinant what Commission he had to examine any man there and withall drew his sword aboue half out & then his hand was stayed by the Constable & some other this Examinant answering that he was Captaine of the watch & that they should <W> Know that he had authority & this Examinant then desired Mr Darcy that the said Birt might be forth comming but Mr Darcy said that he would take noe charge of him but bad this Examinant goe up to Birts chamber & take what course he would with him whereupon this Examinant went out & sett a Guard upon the howse Thereupon one of the Company in the howse came to the dore & said he was a Captaine & speakeing to the Centinell said that he would giue him the strapado
