The Examinacion of James Kirvan of the towne of Catterlagh in the County take{n} vpon oath before mee Coll Henry Pritty one of the Justices of peace for the province of Leinster; this 18th of August 1652
<A> This Examinant being duly sworne sayth that Jame{s} ffraney in the Barrony of Iddrone in the County of Catterlagh; betweene Kilknock mill & Laughlin bridg in the said County receiued a paper from one Charles Dempsey, but what was writt therein this examinant knoweth not, which said paper in the same place the said ffrany deliuered vnto one Teige <B> Maurtin, a Sarjeant of Collonell Bagnells Comp Company; whoe was Convoying one Richard Lake as they gaue out to Ross & Duncanon to goe into England haueing a Comaunded partie out of foure Companyes in the garrison of Laug{h}lin bridge aforesaid; & this said examinant being a Souldjer in the said Bagnells Company there, went with the said Convoy: & when they came att a plac{e} called Kilkritt betweene the said Laughlin & Barish some three or foure miles from the <C> said Laughlin; The said Sarjeant Comaunded this said Examinant to hange the said Richard Lake, betweeene [his] Carrs; which said Carrs the said James ffraney Coma{unded} to be fetcht out of the said Kilkritt, {where} vpon this examinant asked by what order { } the said Sarjent replyed by this { } hand; shewing the same pape{r} { } from the said [ ] ffrany; & { } of the said Lake the { } of the Carrs to { } refused soe to { } {<D>} { }

Comaunded his owne Seruant to Carry them home; to his owne howse; & which his said seruant likewise refused to doe; wherevpon the said ffrany fell a beateing his said Seruant & [ ] calld his said Seruant Rogue & such like names, and tould him they would ser<ue> to Carry Donge or such kinde of th<ings> well enough; & further saith not:
