The Examination of Mr Thomas Clarke [Marchant] of Dublin but late of Ros in the County of Catherlogh Waxford taken the 13th of August 1652 befor us Col: Henery Prity and Henery Jones two of the Justices of the peace for the prouince of linster
This Examinant duly sworne saith that imediatly vpon the defeate giuen the Irish att Killrush, that Walter Bagnall of Donleckeny in the County of Catherlogh esquire att his returne from <A> the sayd defeate he being there in Armes with the Irish, sesed one the person of Mr John Stone aforesayd Grages in the County of Kelkeney & his sonn and sonn in lawe and his wife and Daustters and vnde{r} pretence of sending them away to Doncanon (which was then an English Garison) he gaue speciall order to his rude Multitude to Execute them by the way the Cause of this Examinants knowledg was from the information of Henery Benet of Ross Marchant which marchant who went purposly from Ross aforesaid to the Grage thinking to preserue them: as also allso from Mathew Roch of the towne of Carlowe prest who tould this deponent with teres, that the sayd Bagnall by his order had Comited the aforesayd Murders for which he wold Com to some Ill end and further this Deponent saith that of his one knowledg that { } William Stone the sonn of the aforsayd J{ohn} Stone fled from his ffather & liued p{ } in Ross aforesayd and this Examinant { } him why he liued not with his fath{er} { } Stone tould him that he the aforesay{d} { } < B> had thretened to put him tohe de th say{d} { } sonn) to death and shortly after { } ocation to goe in to the Contry { } some of the sayd Bag{nall}s { } out a Crocked tre{e} { } wherf{ } Bagn{all} { } the w{ }

This Deponent further saith that he the Deponent being being deliuerd out of Kelkiney prison in the yeare forty three 1643 Came to Ros aforesayd wheare one James Deuerex of Clonleah in the County of Waxford being in Discourse asked this Examinent wheather he thought that the Great Army that Came from Dublin did beatt the Irish Army att the battel of Ros: this Deponent Maiking Ansur that he thought the English army by the prouidence of God did beatt the Irish, but the aforesayd Deuerex replyd no: it was by John Stone and his wife and Chilldren which ware Murdred: two of the women being buryed neere to the place wheare the batle of Ros was fought one of the sayd women being was big with Chilld and the other hauing a small Chilld which was hanged in a with by her and the woman that was big with Chilld some of the Roges haueing striped her hangd her and riped her vp her bely letting the Chilld fall out and soe left them naked vntill Richard ft zhareis FitzHarrys of Colbacke in the County of waxford Caused them to be buried the Cause of this Deponents knowledg is that he was then soueraine of Ros and aforesayd and tooke the Examinacions of Garalld Cauenagh and one ffreny who <C> deposed as aboue writen. This deponent further saith that he discoursing with one Mr James Butler Butler of Tinahinch in the County of Catherlagh he the sayd James sayd he was Charged with the Murder of John Stone and his famely but that he was wronged therin for that it was Comited by his Nephew Bagnall meaning Walter Bagnall {of} Donle{ck}ny in the County of Catherlagh as afore {sayd} {This Depo}nent sayth further that the 12th of { } Captain Jones being { } {Ca]therlagh wheare was { } { } [ ] of { }les of Catherlagh { } { }d of the

death of one Suton reported to haue bin beene latly Executed att waterford for Murder or roberys att the begining of the wares the said Knowls said <E> that he Conceued the sayd Suton to be have been e an honest man the deponent answared that he was Gilty of roberys and Murders in the first part of the Rebelion: what then sayd the sayd Knowles will be Come of Bagnall (meaning Col: Walter Bagnall) for the busnes bu i sines of John Stone the Deponent ansured answered that if he be Gilty of murther he must Ansur for it: and further saith nothing:

This Deponent Thomas Clarke further saith that he being a prisoner in March 1642 1643 in Kilkeny Gale Heard it Creditbly spoken that one William Lilly formerly servant to one Parker a smith and after servant to Walter Bagnall aforesaid & after a souldier in the Army vnder the Command of the Lord of Ormond then Commander in Chefe of the English forces & then beseiging of Ross the foresayd Lilley going out vppon som party was taken prisonor and Hanged to death by the Irish party then att Tinihinch this Deponent then Demanding of andrew { }ly then shr eve of the towne in whos Custody he was why they wolld put an English Souldiers to Death in that maner he madyed answer that he was formerly a seruant to walter {Bagnall} aforesayd & ran away from him and for that they Executed him an{d further} saith note
