Morrice Hicky of Rossmonoughan in the Barrony of Clare Bunratt{y} & County of Clare gent sworne & examined And alsoe John Hinchy of the same hus husbandman sworne & examined depose & say And first the said Morrice Hicky saith That in or about the moneth of August in the yere 164[ ] 1642 he this deponent Lived at Ballicare in the said County & then & there hee being in a feild of wheate which was a reapeing for Mr George Colpace his Mr there came vnto him one Maghown Mc Nemarra of Smithstwone & Teige oge mc <A> Nemarrah Ensigne to Captain Shidy Mc Nemarra whoe presently assaulted & sett vpon his him this deponent & tooke from him his dagger because he looked to his said Masters Corne, telling him he was his prisoner, And then & there some of his the said Mahowne Mc Nemarras complicees vizt told him that Shidy mc Nemarrah & Teige Roe ô Brian had near that place seased on & taken prisoners one John Shaw & another nicknamed Spinola, both servants to Mr Colpace vpon which report both the said Maghown Mc Nemarrah & Teige oge Mc Nemarrah left this deponent & hasted to them the said John Shaw & Spinola & sent them both to Ennis gaole, where they reamained about three weeks And this deponent further saith John Hinchy further saith that he knoweth that the said Shawe & Spinola was were sent from Ennis gaole by Colonell Dermott ô Brian to sixmyle bridge to the said Shidy Mc Nemarrah & Teige ô Brian to be delt withall as they should thinck fitt vpon their comeing thither the said Teige Roe ô Brian & one Connor ô Brian his father examined them but the said Connor ô Brian said that since they cam{e} from Ennis it was fitt they should goe home to Ballicare to the{ir} Mr & therevpon turned them loose to goe to him: But they hadd not g{one} but a little from six mile bridge but that they were pursued seaz{ed} <B> on & murthered wounded by one Donell mc ffinnen of Kilmurry gent an{d} John mc Teig mc Shidy mc Nemarrah now liveing in Ballymoirn{ } in the Barrony of Bunratty the And the deponent sawe the re the {said} John Shaw knockt in the heard by the said Donell mc ffinnen {with} the Butt end of his Muskett: & the said John mc Teig mc Shi{dy} struck & stabbed him with his skeane [ ] But before he was dead the said Conor ô Brian came to the said John Shawe { } he was wounded: vnto whom the said Shaw (soe wounded) desired quarter, Wherevnto the said Connor ô Brian replied that if he { }

in him any hopes of life he should have quarter vpon which the said John Shaw (soe wounded) arose from a ditch where he then was, & followed the said Connor ô Brian a little way And then he fell downe & died of his woundes in this deponents presence & was buried when he sturd & had liffe in him him
